1. Agreement to Terms

Exceptional Surfaces Edmonton Ltd. provides nanotechnology-based surface protection services in Edmonton, Alberta, Canada, including:

• Shingle treatment and roof protection

• Wood treatment and sealing

• Concrete sealant application

• Elastomeric membrane sealant

We are authorized applicators of GoNano© nanosilicate technology products.

3. Eligibility and Service Area

3.1 Service Area

Our services are primarily provided in Edmonton, Alberta, and surrounding areas. Service availability outside this area is subject to evaluation and approval.

3.2 Property Eligibility

Not all surfaces qualify for our treatments. We reserve the right to:

• Conduct inspections to determine eligibility

• Decline service if surfaces do not meet treatment requirements

• Refuse service if warranty conditions cannot be met

4. Inspection and Quotation Process

4.1 Free Inspection

We offer free roof inspections to assess qualification for our 15-year warranty. This inspection does not obligate you to purchase services.

4.2 Quotations

• All quotations are valid for 30 days unless otherwise specified

• Prices are subject to change based on final inspection findings

• Quotations are not transferable to other properties

• Final pricing may vary if additional repairs or preparation work is required

4.3 Project Scope Changes

If additional work is discovered during preparation, we will:

• Notify you promptly

• Provide revised pricing

• Obtain your approval before proceeding

5. Payment Terms

5.1 Payment Methods

We accept:

• Credit and debit cards

• Electronic bank transfers

• Financing through iFinance Canada (subject to approval)

5.2 Payment Schedule

Unless otherwise agreed in writing:

• A deposit may be required to schedule service

• Final payment is due upon completion of services

• Payment terms for financed projects are governed by your financing agreement

5.3 Late Payment

Late payments may result in:

• Interest charges at the rate of 2% per month (26.82% annually)

• Suspension of warranty coverage

• Collection actions

6. Service Delivery

6.1 Scheduling

• Service dates are scheduled based on availability and weather conditions

• We will make reasonable efforts to complete work on scheduled dates

• Weather-related delays are beyond our control and do not constitute breach of contract

6.2 Site Access

You agree to:

• Provide clear access to work areas

• Remove obstacles or items that may interfere with service

• Ensure pets are secured during service

• Inform us of any hazards or special conditions on the property

6.3 Service Completion

Most applications are completed in one day. Actual completion time may vary based on:

• Property size and complexity

• Weather conditions

• Required preparation or repair work

7. Warranties

7.1 Treatment Warranty

Our treatments come with warranties ranging from 10-15 years, subject to:

• Surface qualification during initial inspection

• Proper surface preparation

• Adherence to maintenance requirements

• Timely payment of all fees

7.2 Warranty Coverage

The warranty covers:

• Product performance as specified in warranty documentation

• Material defects related to the treatment application

• Reapplication if treatment fails within warranty period

7.3 Warranty Exclusions

The warranty does NOT cover:

• Damage from improper maintenance or alterations

• Damage from accidents, natural disasters, or acts of God

• Normal wear and aging of underlying materials

• Damage from power washing or harsh chemicals

• Structural issues unrelated to our treatment

• Pre-existing conditions not addressed during service

7.4 Warranty Claims

• Allow us to inspect the treated surface

• We will assess and respond within 14 business days

7.5 Warranty Remedy

Our sole obligation under warranty is to reapply treatment or refund the service cost (pro-rated based on years of coverage used). We are not liable for consequential damages.

8. Limitation of Liability

8.1 Maximum Liability

Our total liability for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim.

8.2 Excluded Damages

We are not liable for:

• Indirect, incidental, or consequential damages

• Lost profits or business interruption

• Property damage not directly caused by our negligence

• Claims made after the warranty period expires

• Damages exceeding the service cost

8.3 Third-Party Products

We are authorized applicators of GoNano© products. While we stand behind our application, the performance of the underlying product technology is subject to GoNano's specifications and warranties.

9. Intellectual Property

9.1 Website Content

All content on our Website, including text, graphics, logos, images, and software, is the property of Exceptional Surfaces Edmonton Ltd. or its licensors and is protected by copyright and intellectual property laws.

• iFinance Canada's privacy practices or policies

12.2 Service Obligation

Approval of financing does not change our service obligations. All service terms in this agreement remain in effect regardless of payment method.

13. Cancellation and Refund Policy

13.1 Cancellation by Customer

• Cancellations more than 7 days before scheduled service: Full refund of deposit

• Cancellations 3-7 days before scheduled service: 50% refund of deposit

• Cancellations less than 3 days before scheduled service: No refund of deposit

• Cancellations after service begins: No refund

13.2 Cancellation by Company

We may cancel services if:

• Weather conditions make service unsafe or ineffective

• Property fails eligibility requirements upon final inspection

• You fail to provide site access or necessary accommodations

• Payment issues arise

In such cases, deposits will be refunded unless cancellation is due to customer breach.

13.3 Refunds

Refunds are processed within 14 business days to the original payment method.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, parties agree to attempt good-faith negotiations to resolve disputes.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in Edmonton, Alberta, under the Arbitration Act (Alberta).

14.3 Exceptions

Either party may seek injunctive relief in court for:

• Intellectual property violations

• Breach of confidentiality

• Collection of undisputed amounts owed

15. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any written service agreement, constitute the entire agreement between you and Exceptional Surfaces Edmonton Ltd. regarding our services.
